Eurocommerce loses legal dispute with Rabobank

Yesterday Rabobank and the other trustees of the bankrupt real estate company Eurocommerce Holdings have won the legal dispute with Gevi International BV, the owner of the former Stal Eurocommerce. This means that all real estate property and Gerco Schröders horses, will be under the right of pledge of Rabobank. In a press release, Ger Visser jr. announced to appeal against the verdict immediately. Bottom line is that Gerco Schröder might lose his famous Belgian Warmbred, Eurocommerce London. It was assumed that the waiver by Eurocommerce of more than 38 million in the jumping stable of Ger Visser jr. was unlawful. Ger Visser sr. transferred the equine branch of his ‘empire’ to his son through the delivery of shares to Gevi International, a loan agreement between Eurocommerce and Gevi International and a sponsorship agreement between Eurocommerce and Gevi Gorssel. This way, at the end of 2011, Gevi International came into the possession of stal Eurocommerce, including the property and all horses. Gevi Gorssel (predecessor of Gevi International) now has to pay € 38,250,000.00, plus contractual interest of 4% a year, to Rabobank. Furthermore, the court ruled that Gevi International acted unlawfully in selling the Grand Prix stallion Vigaro and take the proceeds from those sales out of the reach of Rabobank. © Paardenkrant/Equnews
